By using Yish, you agree to these Terms of Service. If you do not agree, please do not use the software. These Terms form an agreement between you and SafeX Inc. ("we", "us").
Yish is provided free of charge for personal and commercial use. We grant you a non-transferable, non-exclusive license to use the app. You may not reverse-engineer, decompile, resell, or distribute modified versions of Yish.
Screenshots and recordings you create with Yish are entirely yours. By default they are stored only on your own computer (~/Pictures/yish/); Yish does not access or upload them. You are responsible for backing up your own files, and we are not liable for any data loss.
You agree not to:
Yish checks for updates via the Sparkle framework and may download and install them. By using Yish you consent to these update checks. An update check requests only release metadata (release/appcast.xml) and sends no data that identifies you.
Yish is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, SafeX Inc. is not liable for any damages arising from the use or inability to use Yish, including but not limited to data loss.
Governing Law. These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles.
Informal Resolution. Before bringing any formal claim, you agree to first contact us at infosafex.cloud and attempt in good faith to resolve the dispute informally.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the service that is not resolved informally shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in a court of law. The arbitration shall be seated in Orange County, New York, and judgment on the arbitrator's award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.
Class Action Waiver. You and SafeX Inc. agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any class or representative proceeding.
Jury Trial Waiver. To the fullest extent permitted by applicable law, you and SafeX Inc. waive any constitutional or statutory right to sue in court and to have a trial before a judge or jury, electing instead that all disputes be resolved by arbitration as set out above.
Severability. If the Class Action Waiver above is found unenforceable as to any claim, that particular claim shall be severed and adjudicated in a court of competent jurisdiction in Orange County, New York, while all remaining claims proceed in arbitration.
We may update these Terms from time to time. Changes are reflected by the "Last updated" date above, with no separate notification. Your continued use of Yish after a change means you accept the updated Terms.
